Chelsea Hillcrest PUD receives OK with conditions from Sylvan Township Planning Commission

Chelsea Hillcrest’s preliminary site plan for a 17-unit Planned Unit Development was unanimously approved 5-0 (Herrick absent) by the Sylvan Township Planning Commission at its Feb. 23 meeting.

The preliminary site plan was first filed nearly a year ago in March of 2016 and was tabled on four occasions to work out issues.

Township Attorney Mariah Fink told the planning commission, “I helped to develop this resolution. Chelsea Hillcrest has a duty to repair any road that they damage.”

The Chelsea Springs Condominium property and Chelsea Hillcrest Property share roads and utilities.

The planning commission’s approval of the preliminary site plan is subject to the following conditions:

  1. Chelsea Hillcrest Investments, LLC shall establish ingress and egress over the Chelsea Springs roads and sidewalks and establish utilities easements via one of three mechanisms:

Coming to an agreement with Chelsea Springs Condominium Association to merge the newly constructed units on the Chelsea Hillcrest Property into the Chelsea Springs development, becoming part of that development subject to that development’s Master Deed provisions regarding maintenance and repair of the roads and utilities serving the Chelsea Springs units and the new Chelsea Hillcrest units;-OR-
  3. Creating its own Chelsea Hillcrest association (with its own Master Deed, Bylaws, etc.) with an agreement with the Chelsea Springs Condominium Association to establish the required easements and share the costs of maintenance and repair of the roads, sidewalks, and utilities serving the Chelsea Springs units and the new Chelsea Hillcrest units; -OR-
  4. Establishing ingress and egress over the Chelsea Springs roads and sidewalks and establishing utilities easements via any other legal means.
  5. Chelsea Hillcrest Investments, LLC must execute a new development agreement with the township to replace the original agreements contemplating the Planned Unit Development.
  6. Chelsea Hillcrest Investments, LLC shall file a bond, or other security with the township for the contemplated improvements to be made on the Chelsea Hillcrest Property.

In other action, the planning commission unanimously voted to approve the resolution to approve the 2017 Masterplan, which now goes to the Sylvan Township Board.

The planning commission received helpful feedback from resident Patrick Zieske, which was addressed, along with feedback from the City of Chelsea.

The Master Plan consists of “research and analyses of land use, demographics, residential and agricultural uses, retail and office uses, industrial and commercial development, community and government facilities, transportation, recreation, as well as natural resource opportunities; and has used the analyses of this data to prepare a future land use map that provides for the allocation of future development to accommodate single family and multi-family residential housing, office, commercial and industrial development, agriculture, public and private institutional uses.”
